GlueX General Terms of Service

By accessing or using our Services, you agrwee to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

2.1 Age and Legal Capacity

To use our Services, you must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction. By using the Services, you represent and warrant that you meet these eligibility requirements and that you are legally capable of entering into a binding agreement.

The Services are not available to individuals or entities in jurisdictions where their use would violate applicable laws or regulations. By accessing or using our Services, you affirm that you are not subject to any sanctions or restrictions under applicable laws.

3.1 Nature of Services

GlueX facilitates decentralized financial transactions by optimizing interactions with liquidity sources and DeFi protocols. GlueX does not act as a custodian, intermediary, or financial advisor. Users bear full responsibility for their transactions.

3.2 Third-Party Services

GlueX may integrate or interact with third-party services. We do not endorse, control, or assume liability for the actions, policies, or terms of third-party service providers.

4. Compliance and Restrictions

4.1 Regulatory Compliance

Users are solely responsible for ensuring compliance with applicable laws, including but not limited to anti-money laundering (AML) and know-your-customer (KYC) regulations.

4.2 Prohibited Activities

You may not use the Services to:

• Engage in fraudulent, unlawful, or prohibited transactions.
• Violate intellectual property or proprietary rights.
• Circumvent security measures or distribute malicious software.
• Facilitate money laundering, terrorist financing, or illicit financial activities.
• Manipulate market prices, execute wash trades, or engage in deceptive practices.

4.3 Sanctions Compliance

You affirm that you are not located in, organized under the laws of, or otherwise subject to sanctions in any jurisdiction restricted by international regulatory authorities, including but not limited to the European Union (EU), the United States Office of Foreign Assets Control (OFAC), or the United Nations (UN).

5. Intellectual Property

5.1 Ownership

All rights, titles, and interests in GlueX’s platform, content, and technology, including but not limited to trademarks, patents, copyrights, and trade secrets, are owned by OTEX B.V. No licenses or rights are granted except as expressly stated herein.

5.2 License Grant

Subject to compliance with these Terms, GlueX grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services solely for lawful purposes.

5.3 Restrictions

Users may not:

• Reverse-engineer, decompile, or disassemble any part of the Services.
• Remove, alter, or obscure any proprietary notices.
• Copy, reproduce, distribute, or create derivative works without prior written consent.

6. Disclaimers and Limitations of Liability

6.1 No Warranties

The Services are provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied. GlueX disclaims all warranties, including but not limited to fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Users acknowledge that:

• Transactions on blockchain networks are irreversible.
• Smart contracts may contain vulnerabilities.
• The value of digital assets may fluctuate significantly.

6.3 Limitation of Liability

To the fullest extent permitted by law, GlueX, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the Services.

Your use of GlueX is subject to our Privacy Policy, which outlines how we collect, store, and process personal data. By using our Services, you consent to our data handling practices.

These Terms are governed by and construed in accordance with the laws of the Netherlands.

10.2 Jurisdiction

Any disputes arising under these Terms shall be resolved exclusively in the courts of Amsterdam, Netherlands.
